Falling Inn Love

Netflix has dropped the first trailer for its upcoming film “Falling Inn Love” this week. Our senior lawyer, Sarah Caughey, worked hard behind the scenes on the first Netflix original feature production filmed in NZ. The rom-com, directed by Roger Kumble, is about an American city girl who wins The Bellbird Valley Farm in a competition and ditches city life to remodel and flip the rustic property.

Copyright Chaos?

Katy Perry and her record label, Capitol Records, have been hit with a USD$2.7 million copyright judgment following allegations by Marcus Gray that Perry’s hit song ‘Dark Horse’ copied the beat of his Christian rap song ‘Joyful Noise’. Commentators argued that the similarities between the songs were insufficient to constitute copyright infringement, contributing to growing concerns that the balance of artistic freedom of expression versus copyright protection is weighing heavily in favor of the latter. The case raises questions as to whether the verdict could lead to a new wave of copyright infringement lawsuits.

Film News

Our film lawyers have been working hard behind the scenes with Endeavor Content on the screen adaptation of Australian novel, Penguin Bloom, starring Naomi Watts, Andrew Lincoln and Jackie Weaver. The film is based on the true story of a young Sydney family who struggle to come to terms with their mother’s near fatal tragedy and an injured magpie who helps the family recover. Filming started in Sydney last week and release is scheduled for 2020.

OneMusic Australia

Today marks the launch of OneMusic Australia, the biggest overhaul of Australia’s music licencing system in almost a century. OneMusic is a joint initiative between APRA AMCOS and PPCA which aims to simplify music licencing by requiring businesses to apply for one licence, instead of two. According to APRA AMCOS chief executive Dean Ormston, unifying music copyright management will make compliance easier and make sure rights holders are fully remunerated when their music is played in public.

Music Festival Licence

The NSW government will be introducing a new type of liquor licence specifically for music festivals from March 2019. Each licence will be approved by a specialist panel and it is reported that a breach of licence conditions may see organisers face penalties of up to $110,00 or imprisonment.

Not McHappy

The European Union Intellectual Property Office (EUIPO) has removed McDonald’s ‘Big Mac’ trade mark in the EU. The decision follows a challenge from Irish fast food chain ‘Supermac’ for McDonalds to prove continuous and genuine use of the trade mark across the EU, to which the EUIPO found insufficient evidence of use beyond UK, France and Germany. Whilst the judgment will most-likely be appealed, it serves as a reminder that simply registering a trade mark will not guarantee protection unless you can also demonstrate actual, sustained use the mark.

It’s 2019, which means that all copyrighted works in the US that were published in 1923 have now fallen into the public domain (with a few exceptions). This marks the first time since 1998 that works in the US have entered the public domain due to various copyright extension acts that have steadily increased the term of copyright protection. Will 2019 see another attempt from the US to continue to extend the duration of copyright protection, or has it reached it’s limit?

Too Gouda To Be True

In the Netherlands this week the European Court of Justice has found that there is no copyright in the taste of ‘cheese’. The decision follows attempts by Levola Hengelo, a Dutch food company, to claim monopoly over the taste of a cheese spread. The court found that “…the taste of the cheese could not be defined with enough precision and objectivity to make it clear to other companies where they might be overstepping the mark.”

We had a great night celebrating NZ songwriters at the 2018 APRA Silver Scroll Awards!

Congratulations to our client Marlon Williams – who took out the Silver Scroll Award for composing the hit ballad “Nobody Gets What They Want Anymore”. Fake it til you make it

Aldi has again been given the all clear for mimicking major brands in their stores. Israel beauty company Moroccanoil Israel Ltd lost on appeal to the Full Court of the Federal Court when they claimed ALDI was infringing trade mark, passing off, and misleading and deceiving consumers with their similarly branded hair products. The court found that there was ‘no real, tangible danger’ that ALDI’s budget, no-brand products could be confused with luxury brands. This case follows the decision against US snack food giant Frito-Lay, who unsuccessfully tried to sue ALDI for their knock off Twisties, ‘Cheezy Twists’ back in 2001.

Spotify is launching a new software called ‘Line-In’ that will allow users to edit track details to provide more accurate descriptions of genres, mood, tags, artist roles and other information. Spotlight on Independent Theatre

The Media, Entertainment and Arts Alliance (MEAA) has released their first set of best practice guidelines specifically aimed at Independent Theatre Productions. The guidelines were released in response to long rehearsal hours, little to no remuneration and unsafe work environments in the independent theatre scene. If you’re thinking of putting on a production, or are participating in a show, familiarise yourself with these new standards that are sure to shake up this industry.

Emoji are just harmless, funny images at the end of a text, right? Well in the legal industry they are becoming an increasingly serious problem. A court in New Zealand recently had to grapple with Emoji that were placed at the end of death threats, whilst a judge in the Supreme Court of QLD had to decide how to interpret a smiley face Emoji in a will.

Infringement Alert

The owner of the famous feline internet sensation ‘Grumpy Cat’ has successfully sued a coffee shop in California for AUD$883,000 for breach of a copyright licensing agreement. The café had originally paid Grumpy Cat Ltd a fee to use the famous cat-meme on their ‘Grumpaccino’ iced coffees, but they overstepped the bounds of their agreement when they started to use Grumpy Cat’s image to promote their other products as well.

Are you thinking about using another person (or cat’s!) image to promote your business? To avoid a law suit down the line, make sure you are aware of what you can and can’t do when using an image that isn’t your own.

Each year, APRA AMCOS in conjunction with the Australian Guild of Screen Composers present the Screen Music Awards. The ceremony held last week (which is always one of our favourite events of the year) acknowledges excellence and innovation in the field of screen composition. Not only were we treated to performances by Missy Higgins and Briggs (w/ Caiti Baker) – but both artists were honoured with wins in their respective categories:

– Best Television Theme (Fox League Super Saturday) Composed by Briggs, Justin Shave and Charlton Hill; and

– Best Original Song Composed For The Screen (Torchlight from Don’t Tell) Composed by Missy Higgins.
