Fake it til you make it

Aldi has again been given the all clear for mimicking major brands in their stores. Israel beauty company Moroccanoil Israel Ltd lost on appeal to the Full Court of the Federal Court when they claimed ALDI was infringing trade mark, passing off, and misleading and deceiving consumers with their similarly branded hair products. The court found that there was ‘no real, tangible danger’ that ALDI’s budget, no-brand products could be confused with luxury brands. This case follows the decision against US snack food giant Frito-Lay, who unsuccessfully tried to sue ALDI for their knock off Twisties, ‘Cheezy Twists’ back in 2001.
